La Fenomenología no podía evitar la misma suerte. Después de un rápido panorama en lo tocante a la fenomenología husserliana y el solipsismo, pasamos a exponer críticamente el texto de las Meditaciones cartesianas de Husserl, específicamente la quinta. BackgroundOrgan transplantation represents the most effective and acceptable therapy for end-stage organ failure. However, its frequent practice often leads to a shortage of organs worldwide. To solve this dilemma, some countries, such as Portugal, have switched from an opt-in to an opt-out system, which has raised concerns about respect for individual autonomy. We aimed to evaluate whether young university students are aware of this opt-out system so that they can make informed, autonomous and conscious decisions, as well as to identify (...) the factors that determine a positive attitude toward post-mortem organ donation.MethodsAn observational, cross-sectional study was developed and a questionnaire was administered to first-year students from six faculties of the University of Porto.ResultsOf the 841 participants, 60% were unaware that Portugal had adopted an opt-out system. Among the informed individuals, their main sources of information included social media, internet, and family. Furthermore, only 48% of all participants agreed with the current opt-out system. Female sex (p = 0.049; OR 1.393), knowledge of the law (p < 0.001; OR 4.749) and family being the primary source of information (p < 0.001; OR 2.855) were independent factors associated with a positive attitude toward post-mortem organ donation law.ConclusionsThere is a significant lack of knowledge among young university students regarding the presumed post-mortem organ donation law and how it works. Female sex, having family as a primary source of information and being aware of the presumed post-mortem organ donation law are the strongest independent factors that determine a positive attitude toward the opt-out system. While ethics in publishing has been increasingly debated, there seems to be a lack of a theoretical framework for making sense of existing rules of behavior as well as for designing, managing and enforcing such rules. This letter argues that systems-oriented disciplines, such as complexity science and human factors, offer insights into new ways of dealing with ethics in publishing. Some examples of insights are presented. Also, a call is made for empirical studies that unveil the context and details of (...) both retracted papers and the process of writing and publishing academic papers. This is expected to shed light on the complexity of the publication system as well as to support the development of a just culture, in which all participants are accountable. (shrink)

Television, newspapers and magazines often discuss the presence in Japan of dekasseguis from Brazil. This migratory movement, which started in 1985, has started to show signs of decline. The recession in Japan has been accompanied by the laying off of around 20,000 Brazilian dekasseguis - employed in businesses in the industrial sector (cars, electronics and food production) - which explains the reduction in the number of candidates for departure.The emigrants have generally been drawn by attractive salaries, while always aware that (...) they were being offered work refused by the local population, considered kitsui (heavy), kitani (dirty) and kiken (dangerous). The hope of amassing sufficient savings in a few years to enjoy a better standard of living on their return to Brazil weighed significantly on their decision to leave. (shrink)

Niche construction theory highlights the active role of organisms in modifying their environment. A subset of these modifications is the developmental niche, which concerns ecological, epistemic, social and symbolic legacies inherited by organisms as resources that scaffold their developmental processes. Since in this theory development is a situated process that takes place in a culturally structured environment, we may reasonably ask if implicit cultural biases may, in some cases, be responsible for maladaptive developmental niches. In this paper we wish to (...) argue for an affirmative answer. In order to do so, we first propose to conceptualize implicit bias as embodied perceptual habits, and then proceed to show that these habits are at least partially responsible for maladaptive developmental niches of children with Down syndrome and autism. With this framework we thus hope to bring together two fields of research that haven’t been explicitly connected: implicit bias and niche construction theory. Linking these two theories may bring benefits both to implicit bias researchers, who can extend this concept to characterize other sets of processes as biased, as well as to niche construction theorists, who will have a useful theoretical tool to diagnose maladaptive features of niches brought about by sociocultural biases. A obra de Ronald Dworkin é extensa e passou por quase 50 anos. Dessa forma, para entender seu significado e sua relevância é necessário debater de forma responsável seus principais conceitos para que enganos de interpretação sejam evitados. Nesse contexto, o objetivo principal deste artigo é explicar claramente os conceitos de perspectiva do participante, conceito interpretativo e dimensões da interpretação. Por meio de pesquisa bibliográfica, a conclusão é que propor uma teoria da perspectiva do participante é uma ideia de Herbert (...) Hart que Dworkin radicalizou em suas consequências. Nela, é defendida da tese de que não é possível realizar uma teoria jurídica sem se comprometer com a prática institucional estudada. Conceito interpretativo, em seguida, explica que o significado de conceitos jurídicos é resultado de um debater em torno de seu significado a partir da melhor luz. Isso se opõe ao conceito de direito como simples fato, em que as respostas disponíveis estão no passado institucional. Por fim, a interpretação possui duas dimensões, uma relacionada a seus fundamentos e outra a sua força. Dessa forma, é possível dizer que ambas estão entrelaçadas e que há uma conexão direta entre direito e política. Dworkin se mantém fiel a esses conceitos durante toda a sua obra. (shrink)

During the past decade, a small but rapidly growing number of Law&Tech scholars have been applying algorithmic methods in their legal research. This Article does it too, for the sake of saving disclosure regulation failure: a normative strategy that has long been considered dead by legal scholars, but conspicuously abused by rule-makers. Existing proposals to revive disclosure duties, however, either focus on the industry policies (e.g. seeking to reduce consumers’ costs of reading) or on rulemaking (e.g. by simplifying linguistic intricacies). (...) But failure may well depend on both. Therefore, this Article develops a `comprehensive approach', suggesting to use computational tools to cope with linguistic and behavioral failures at both the enactment and implementation phases of disclosure duties, thus filling a void in the Law & Tech scholarship. Specifically, it outlines how algorithmic tools can be used in a holistic manner to address the many failures of disclosures from the rulemaking in parliament to consumer screens. It suggests a multi-layered design where lawmakers deploy three tools in order to produce optimal disclosure rules: machine learning, natural language processing, and behavioral experimentation through regulatory sandboxes. To clarify how and why these tasks should be performed, disclosures in the contexts of online contract terms and privacy online are taken as examples. Because algorithmic rulemaking is frequently met with well-justified skepticism, problems of its compatibility with legitimacy, efficacy and proportionality are also discussed. (shrink)

International law is not merely a set of rules or processes, but is a professional activity practised by a diversity of figures, including scholars, judges, counsel, teachers, legal advisers and activists. Individuals may, in different contexts, play more than one of these roles, and the interactions between them are illuminating of the nature of international law itself. Para Hegel as leis e instituições são resultados da dialética de reconhecimento entre indivíduos e membros de determinada comunidade. Com isto busca-se demonstrar que o reconhecimento é condição de efetividade das instituições em perspectiva transnacional, sendo o Reconhecimento necessário para efetivação de uma produção do (...) direito funcional em dimensões transnacionais. O artigo emerge de resultado da pesquisa sobre a inserção socioeconômica do Centro de Apoio ao Pequeno Agricultor (Capa) em territórios de remanescentes de quilombos no extremo sul do Estado do Rio Grande do Sul - Brasil. O Capa se caracteriza como uma entidade mediadora, que nasce de motivações eclesiais da Igreja Evangélica de Confissão Luterana no Brasil (IECLB) ao final dos anos de 1970. Seu objetivo é disseminar sistemas agroecológicos entre populações de pequenos agricultores a fim de criar possibilidades (...) alternativas de sobrevivência sustentável no meio rural. A partir do núcleo estabelecido na cidade de Pelotas-RS, o Capa passa a desenvolver atividades entre os grupos de remanescentes de quilombos neste início de século. No encontro com os sujeitos da ação, emergem territorialidades específicas e constroem-se novas identidades. Para além da agroecologia emerge a força da fala. A oralidade constitui-se num instrumental estratégico utilizado pela entidade que possibilita visibilidade social aos grupos com os quais interage. Na dialética decorrente da ação mediadora do Capa recuperam-se saberes autóctones e constroem-se novos saberes considerados essenciais para articular as comunidades diante dos desafios contemporâneos. Agro ecologiaThis article emerges from results of the research on the socioeconomic integration of the Support Center for Small Farmers (CAPA) in the remaining territories of quilombos in the southernmost state of Rio Grande do Sul – Brazil. CAPA is characterized as a mediating entity that has arisen from motivations of the Evangelical Church of Lutheran Confession in Brazil (IECLB) in the late 1970s and its goal is to disseminate agro ecosystems among populations of small farmers in order to create alternative opportunities for sustainable livelihoods in rural areas. Starting from the center established in the city of Pelotas, CAPA has started developing activities among groups of former quilombos at the beginning of this century. From the encounter of the subjects of the action, specific territorialities emerge and new identities are built. Beyond agroecology emerges the power of speech. Orality has become a strategic instrument used by the entity in providing social visibility to the groups it interacts with. In the dialectic due to the mediating action of CAPA, indigenous knowledge is recovered, and new knowledge is built, which is considered to be essential for articulating communities facing the contemporary challenges. O artigo se propõe a uma investigação da potência filosófica presente na poesia japonesa clássica conhecida como waka. O aspecto formal mais proeminente do waka é a sua curta estrutura composta geralmente de 31 sílabas moraicas divididas, respectivamente, em 5 versos de 5, 7, 5, 7 e 7 sílabas cada. Para erguer-se como uma forma poética, o waka emprega o recurso rítmico da pausa e uma retórica que vinculam cada poema individual ao todo da tradição através de precedentes. Defendemos que (...) na tradição intelectual constituída pelo waka há uma filosofia do real – que denominamos intertextualidade do real – que entende a realidade como vazia e impermanente. Dessa forma, seria o waka a forma mais adequada através da qual exprimir o real uma vez que ele é mais profundo e excelente a medida em que cria um movimento de esvaziamento e tornar impermanente através de seus recursos formais e retóricos: seu cerne, sua disposição e significado e suas palavras. Na crise estrutural do capital, iniciada na década de 1970, foi inaugurado o chamado capitalismo neoliberal, no cerne do qual o tema da formação política parece ter assumido destacada importância. Em sua radicalidade emancipatória, a formação política encontra-se inextrincavelmente vinculada à luta dos movimentos sociais populares, atravessando, portanto, a totalidade das atividades desenvolvidas pelos sujeitos coletivos em movimento. O objetivo do artigo é tecer algumas considerações sobre o tema da formação política no interior dos movimentos sociais populares. Para tanto, lançaremos (...) mão de uma pesquisa bibliográfica ancorada em alguns breves relatos de militantes colhidos através de entrevistas semiestruturadas, a partir do nosso trabalho militante no seio da luta social. Alguns desses relatos constituem igualmente resultados parciais da nossa pesquisa de mestrado no Programa de Pós-Graduação em Educação Brasileira da Universidade Federal do Ceará (UFC). O título da pesquisa é: Práxis político-educativa do sujeito potencialmente revolucionário nas associações de moradores: a experiência da Associação de Moradores do Bairro da Serrinha (AMORBASE). O campo empírico da pesquisa é o território Serrinha, situado na periferia da cidade de Fortaleza, capital do estado do Ceará. O artigo encontra-se fundamentado nos pressupostos do materialismo dialético tal como formulado por Marx e Engels (2007). No artigo, a formação política, no interior dos movimentos sociais populares é compreendida como um fenômeno mais abrangente e mais denso complexamente articulado uma vez que atravessa a totalidade das atividades organizadas pelos sujeitos coletivos em movimento. This article offers an explanation of perhaps Wittgenstein’s strangest and least intuitive thesis – the semantical mutation thesis – according to which one can never answer a mathematical conjecture because the new proof alters the very meanings of the terms involved in the original question. Instead of basing our justification on the distinction between mere calculation and proofs of isolated propositions, characteristic of Wittgenstein’s intermediary period, we generalize it to include conjectures involving effective procedures as well.

Essa pesquisa elege como material específico de análise uma sequência de cursos oferecidos pelo “YouTube Academy” para a criação, gerenciamento e divulgação de uma empresa associada à plataforma de vídeos do YouTube. O objetivo é investigar os modos de imbricação e/ou separação entre o sujeito e a empresa. Para construir os procedimentos analíticos, delimitamos as seguintes perguntas: Como as formas imaginárias do sujeito (o “eu”, a identidade e a individualidade) estão relacionadas com a criação e o funcionamento de uma empresa (...) no YouTube? Como o trabalho e as relações de trabalho são significados nessa discursividade? A pesquisa é filiada à Análise de Discurso Materialista, em diálogo com autores que analisam as relações de trabalho contemporâneas. O olhar discursivo chega a três regularidades: 1) homogeneização das diferentes condições de produção no trabalho dos youtubers; 2) o paralelismo discursivo entre sujeito, canal e empresa (negócio); 3) uma retórica do equilíbrio entre “vida profissional” e “vida pessoal”. O material se sustenta no funcionamento de uma busca pela saturação dos sentidos com soluções e cursos para cada uma das etapas da (re)produção desse trabalho, para a suposta totalidade do processo. The specific analysis material for this essay was chosen from a sequence of courses, offered by the “YouTube Academy”, with the aim of creating, managing and announcing a company associated with the YouTube video platform. Its goal is to examine the ways of imbrication and/or separation between the subject and the company. In order to build the analytical procedures, we delineated the following questions: How are the imaginary for ms of the subject (the “self” as identity and individuality) related to the creation and operation of a company on YouTube? How are work and work relations meant in this discursivity? The research is affiliated with Materialist Discourse Analysis, in dialogue with authors who analyze contemporary work relations. The discursive look reaches three regularities: 1) homogenization of the different production conditions in the work of “youtubers”; 2) the discursive parallelism between subject, channel and company (busi-ness); 3) a rhetoric of the balance between “professional life” and “personal life”. The material is based on the operation of a search for the saturation of the senses with solutions and courses for each of the stages of the (re)production of this work, for the supposed totality of the process. Since its onset, scholars have characterized social media as a valuable source for data collection since it presents several benefits (e.g. exploring research questions with hard-to-reach populations). Nonetheless, methods of online data collection are riddled with ethical and methodological challenges that researchers must consider if they want to adopt good practices when collecting and analyzing online data. Drawing from our primary research project, where we collected passive online data on Reddit, we explore and detail the steps that researchers must consider (...) before collecting online data: (1) planning online data collection; (2) ethical considerations; and (3) data collection. We also discuss two atypical questions that researchers should also consider: (1) how to handle deleted user-generated content; and (2) how to quote user-generated content. Moving on from the dichotomous discussion between what is public and private data, we present recommendations for good practices when collecting and analyzing qualitative online data. (shrink)

Bertrand’s paradox ) can be considered as a cautionary memento, to practitioners and students of probability calculus alike, of the possible ambiguous meaning of the term ‘at random’ when the sample space of events is continuous. It deals with the existence of different possible answers to the following question: what is the probability that a chord, drawn at random in a circle of radius R, is longer than the side of an inscribed equilateral triangle? Physics can help to remove the (...) ambiguity by identifying an actual experiment, whose outcome is obviously unique and prescribes the physical variables to which the term ‘random’ can be correctly applied. In this paper, after briefly describing Bertrand’s paradox, we associate it with an experiment, which is basically a variation of the famous Buffon’s needle experiment for estimating the value of π. Its outcome is compared with the analytic predictions of probability calculus, that is with the probability distribution of variables whose uniform distribution can be considered a sound implementation of complete randomness. ABSTRACT In this article, we seek, based on the analysis of publications and receptions of works that comprise the referential of Dialogic Discourse Analysis (DDA) in Brazil and a resumption of the trajectory already traced by Brazilian researchers, discuss the path that led to the consolidation of DDA in the country. Thus, four phases of DDA in Brazil are listed. At the first reception phase, scattered readings were identified, based on publications of some works from the Bakhtin Circle in Russian, (...) French, English, Spanish and Italian. The second phase, on its turn, was marked by the publication of the first Brazilian editions of the Circle’s works. At the third phase, Brazilian scholars sought to systematize the concepts and methodologies present in the Circle’s works. Finally, at the last phase, in which we currently are, we seek to consolidate and contextualize DDA more and more through, mainly, the publication of works translated by DDA’s researchers, with critical and historical notes. Autogestão, autoempreendedorismo, infotrabalho, trabalho intermitente, criptomoeda, uberização, proletariado de serviços e servidão digital delineiam uma série de designações indicativas das mudanças das condições de (re)produção do Capital nas suas formas contemporâneas. Grandes corporações como Google, Facebook e Amazon participam desse processo tanto no eixo da infraestrutura econômica, quanto na produção discursiva que sustenta ideologicamente as relações de trabalho determinadas pelo Aparelho Digital. Essa pesquisa elege como material específico de análise uma sequência de cursos oferecidos pelo “YouTube Academy” para a criação, (...) gerenciamento e divulgação de uma empresa associada à plataforma de vídeos do YouTube. O objetivo é investigar os modos de imbricação e/ou separação entre o sujeito e a empresa. Para construir os procedimentos analíticos, delimitamos as seguintes perguntas: Como as formas imaginárias do sujeito (o “eu”, a identidade e a individualidade) estão relacionadas com a criação e o funcionamento de uma empresa no YouTube? Como o trabalho e as relações de trabalho são significados nessa discursividade? O olhar discursivo é ainda guiado por compreensões de pesquisas anteriores: o modo como o “eu” é discursivizado em produto, o funcionamento da “empresa de si” como modelo de identificação e a empresarialidade. As referências passam por Michel Pêcheux, Eni Orlandi, Suzy Lagazzi, Luciana Nogueira, Guilherme Adorno, Joel Bombardelli, Pierre Dardot, Christian Laval e Ricardo Antunes. O conceito de político, compreendido discursivamente como conflito e disputa pelos sentidos - e seus efeitos de deslocamento, assim como o apagamento do político do lugar que lhe seria próprio - e o conceito de exterioridade discursiva são mais enfaticamente mobilizados na pesquisa, além das discussões em torno do discurso neoliberal e da psicologização do sujeito pelos efeitos discursivos de liberdade e autonomia. Um trabalho de análise da constituição da discursividade que tem o “sentido (já) lá” como resultado do efeito de exterioridade. Esperamos mostrar, assim, como, nas condições de produção sócio-históricas de um “Imperialismo Digital”, uma mudança da “economia política do poder-dizer” afeta os modos de circulação não só dos discursos, mas do próprio Capital. This paper deals with the mutations in Wittgenstein’s treatment of the notions of “generality” and of “singularity”, from his first philosophy, in the Tractatus Logico-Philosophicus, to his later mature philosophy represented by the Philosophical Investigations. As we shall see, Wittgenstein’s philosophical handling of the notion of “visual perception” plays a key role in those conceptual transformations.

In many experimental sciences, like particle physics or molecular biology, the proper place for establishing facts is the laboratory. In the sciences of population biology, however, the laboratory is often seen as a poor approximation of what occurs in nature. Results obtained in the field are usually more convincing. This raises special problems: it is much more difficult to obtain stable, repeatable results in the field, where environmental conditions vary out of the experimenter’s control, than in the laboratory. We examine (...) here how this problem affected an influential experimental research tradition in community ecology, the study of the ecology of the rocky seashores. In the 1960s, a handful of North-American ecologists, most notably Joseph Connell, Robert Paine and Paul Dayton, made the rocky seashores a model study system for experimenting in the field. Their experiments were deceptively simple: they removed species living on the seashore and described the resulting effects on the local ecology. These experiments exerted a deep influence on community ecology. They provided evidence for speculative developments concerning the theory of interspecific competition, the factors responsible for species richness and the ecology of food webs. They also stimulated novel conceptual developments. In particular, Paine developed the predation hypothesis, which states that the presence of predators can favour species richness, before introducing the keystone species concept, according to which some species exert disproportionate effects on ecological systems. More broadly, these experiments gave support to a methodological trend in favour of field experimentation. Only controlled perturbations in the field, it seemed, provided a reliable method to get insights into the structure of ecological communities. However, as experiments were continued in time and repeated in different sites, divergent results appeared. We analyse here how intertidal researchers coped with the variability of environmental conditions and tried to stabilize their results. In the process, they reconsidered not only their early conclusions, but also the exclusive status given to field experiments. Expanding on this case study, we discuss some significant differences between laboratory and field experiments. (shrink)

According to the dual inheritance theory, cultural learning in our species is a biased and highly efficient process of transmitting cultural traits. Here we define a model of cultural learning where social learning is integrated as a complementary element that facilitates the discovery of a specific behavior by an apprentice, and not as a mechanism that works in opposition to individual learning. In that context, we propose that the emergence of the ability to approve or disapprove of offspring behavior, orienting (...) their learning, transformed primate social learning into a cultural transmission system, like that which characterizes our species. Assessor teaching facilitates the replication and/or reconstruction of behaviors that are difficult to imitate and helps to determine which behaviors should be imitated. We also explore the form in which assessor teaching has conditioned the evolution of our abilities to develop cultures in the hominin line, converting us into individuals equipped with what we call a suadens psychology. Our main point is to defend the hypothesis that suadens psychology determines the stability and dynamics that affect the trajectories of many cultural characters. We compare our proposal with other theories about cultural evolution, specifically with dual inheritance theory and cultural attraction theory. (shrink)

The objective of this article is to try to elucidate Wittgenstein’s ex-travagant thesis that each and every mathematical advancement involves some “semantical mutation”, i.e., some alteration of the very meanings of the terms involved. To do that we will argue in favor of the idea of a “modal incompati-bility” between the concepts involved, as they were prior to the advancement, and what they become after the new result was obtained. We will also argue that the adoption of this thesis profoundly (...) alters the traditional way of con-struing the idea of “progress” in mathematics. (shrink)

Humans have developed the capacity to approve or disapprove of the behavior of their children and of unrelated individuals. The ability to approve or disapprove transformed social learning into a system of cumulative cultural inheritance, because it increased the reliability of cultural transmission. Moreover, people can transmit their behavioral experiences (regarding what can and cannot be done) to their offspring, thereby avoiding the costs of a laborious, and sometimes dangerous, evaluation of different cultural alternatives. Our thesis is that, during ontogeny, (...) the evaluative communication (approval/disapproval) between parents and offspring is substituted by other evaluative communications among peers, like individuals of the same generation. Each person belongs to a reference social group with individuals that interact more intensively. Humans have developed psychological mechanisms that enable cultural transmission by being receptive to parental advice as well as their reference social group. The selective pressure that promoted these new evaluative interactions arose to facilitate the establishment of efficient cooperative relationships. In short, the social control of behavior is essential to understand human cultural transmission. (shrink)

Objetiva-se com este artigo uma breve investigação sobre a relação existente entre Fé e Razão, especificamente no que toca à compreensão do intellectus fidei e da ratio fidei enquanto desdobramento temático. De acordo com a Carta Encíclica Fides et Ratio, a Fé e a Razão se assemelham a duas asas com as quais o espírito humano se eleva à contemplação da verdade. O desejo de conhecimento da verdade e, por conseguinte, de Deus e de si próprio é apontado como uma (...) vocação divina colocada no coração do homem por Deus. Embora as questões de fé possam passar por um tratamento racional, a fé possui a sua inteligência própria, específica não se limitando a esquemas relativos à razão demonstrativa, científica ou discursiva. A proof method for automation of reasoning in a paraconsistent logic, the calculus C1* of da Costa, is presented. The method is analytical, using a specially designed tableau system. Actually two tableau systems were created. A first one, with a small number of rules in order to be mathematically convenient, is used to prove the soundness and the completeness of the method. The other one, which is equivalent to the former, is a system of derived rules designed to enhance computational (...) efficiency. A prototype based on this second system was effectively implemented. Tem-se por objetivo discorrer sobre a problemática acerca do uso de máscaras em manifestações públicas, especificamente acerca da proibição de seu uso em manifestações pacíficas. As liberdades de manifestação do pensamento e de reunião são direitos fundamentais previstos no artigo 5º da Constituição de 1988, constituindo cláusulas pétreas. As vedações são capazes de contrariar tais direitos. Por outro lado, há no próprio dispositivo constitucional da liberdade de manifestação do pensamento, a vedação do anonimato.
